This Policy forms part of the Terms of Service. It applies to paid Fomkee subscriptions sold and processed through Paddle as merchant of record. Paddle's buyer terms and Refund Policy also apply to the transaction. This Policy explains how to cancel Fomkee and the additional commitments we make as the service provider. Mandatory rights and Paddle's applicable buyer terms govern if they provide greater protection or conflict with this Policy.

1. Cancelling

You may cancel at any time in the workspace billing settings, when that option is available, in Paddle's customer portal using the manage-subscription link in your receipt, through Paddle buyer support, or by emailing [email protected] from the account owner's email. Cancellation stops the next automatic renewal. Unless a withdrawal, refund, payment reversal or mandatory law requires access to end earlier, the paid plan remains available until the end of the billing period already paid for.

Deleting monitors, leaving a workspace, removing a payment method or simply not using Fomkee does not cancel a subscription. To cancel by email before the next renewal, the workspace owner's request must reach us at least seven business days before the end of the current paid period. We may process a later request in time, but do not guarantee it. This deadline does not apply to cancellation completed through the workspace billing settings or to a consumer's statutory right of withdrawal.

2. Consumer withdrawal rights

If you subscribe as a consumer, applicable law may give you a right to withdraw without giving a reason. Paddle's Refund Policy describes its current country-specific withdrawal periods and transaction rules. Depending on where you live, a right may arise when the contract begins, when the first payment is made after a free trial, or when an annual subscription renews. The 14-day free trial does not replace, shorten or exhaust a later statutory withdrawal period. Any longer or additional mandatory period continues to apply.

To withdraw, use the clearly labelled withdrawal function in workspace billing when available, Paddle's customer portal or Paddle buyer support. You may also send an unequivocal statement to [email protected] before the deadline, and we will pass a transaction-related request to Paddle where needed. It is enough to send the statement before the applicable withdrawal period ends. We will acknowledge an online withdrawal sent to us without undue delay by email or another durable medium. You may use the model form below, but it is not required.

By starting the trial, you expressly request that Fomkee begin providing the selected Service during any initial withdrawal period. We do not charge a subscription fee for Service used during the free trial. A valid withdrawal ends the subscription and any refund due is processed by Paddle under its buyer terms, Refund Policy and applicable law. Access to the affected subscription may end when the withdrawal or refund takes effect.

3. Refunds

Except for a confirmed billing error, an express written guarantee, a refund available under Paddle's buyer terms or Refund Policy, or a right that law does not allow us to exclude, Fomkee does not promise refunds or credits. In particular, we do not promise prorated refunds or credits for unused time, late cancellation, deleted or unused monitors, plan downgrades, downtime, missed checks or alerts, or failures of third-party services. Paddle may separately approve a full or partial refund under its own policy and discretion as the merchant of record.

Request a transaction refund through Paddle's customer portal or Paddle buyer support. You may also email us with the workspace, invoice, date, amount and reason, and we will investigate and assist with confirmed errors. Paddle decides and processes transaction refunds as the merchant of record. Approved refunds normally return to the original payment method; Paddle, banks and payment networks control how long they take to appear.

4. Plan and price changes

The plan purchased remains in effect through its paid billing period. Cancellation before a future renewal prevents renewal into a changed or replacement offer. Upgrades, downgrades and other requested plan changes use the price and effective date shown before confirmation; no change is applied silently to the period already paid for.

5. Suspension or termination by Fomkee

If we end a paid subscription for our convenience, we will ask Paddle to refund the prepaid amount for the unused remainder of the period. No additional refund commitment applies where we suspend or terminate for breach, unlawful use, non-payment, chargeback or urgent security risk, except where Paddle's buyer terms, its Refund Policy or law requires one.

6. Mandatory rights

Nothing in this Policy limits a mandatory cancellation, withdrawal, refund or remedy. Consumer rights apply to subscriptions purchased for purposes outside a trade, business, craft or profession. Contact us promptly if you believe such a right applies.

7. Data after cancellation

Cancellation itself stops renewal but does not delete the account, workspace or Customer Data. Continued non-payment or termination of the Service may lead to suspension and, after reasonable notice, deletion of Customer Data associated with the affected workspace. The Privacy Policy explains retention and deletion. Export information you need before access ends or before requesting workspace deletion.

8. Contact

Billing, cancellation and refund questions: [email protected]. Transaction refund and withdrawal requests may also be submitted through Paddle buyer support.
